1. Introduction

Welcome to ChuiTrails Adventures ("we", "our", "us"). These Terms & Conditions govern your use of our website and the booking of our safari and travel services. By accessing our website or booking a tour, you agree to be bound by these terms.

ChuiTrails Adventures is a registered tour operator in Kenya (Registration Number: [Your Registration Number]). We operate in compliance with the Kenya Tourism Act and all applicable laws in Kenya.

2. Bookings and Reservations

2.1 Making a Booking

• All bookings are subject to availability and confirmation by our team.
• You must provide accurate and complete information when making a booking.
• We reserve the right to refuse any booking at our discretion.

2.2 Age Requirements

• Minimum age for safaris is 6 years (unless otherwise specified).
• Children under 16 must be accompanied by a parent or guardian.
• Some activities (e.g., mountain trekking) may have higher age requirements.

3. Payments and Pricing

3.1 Pricing

• All prices are quoted in US Dollars (USD) unless otherwise stated.
• Prices are subject to change based on currency fluctuations, park fees, and supplier costs.
• Quoted prices are inclusive of all applicable taxes unless specified otherwise.

3.2 Deposit Requirements

• A non-refundable deposit of 30% of the total tour cost is required to confirm your booking.
• For peak season bookings (July-October, December-January), a 50% deposit may be required.
• Full payment is due 60 days prior to the tour departure date.

3.3 Payment Methods

We accept the following payment methods:

• Bank Transfer (Wire Transfer)
• Credit/Debit Card (Visa, Mastercard, American Express) - subject to processing fees
• Mobile Money (M-Pesa) - for local payments in Kenya
• WeChat Pay - for Chinese travelers

4. Cancellation and Refund Policy

4.1 Cancellation by You

Cancellation charges apply as follows:

• 60+ days before departure: 50% of deposit forfeited
• 45-59 days before departure: 75% of total cost forfeited
• 30-44 days before departure: 90% of total cost forfeited
• Less than 30 days before departure: 100% of total cost forfeited

4.2 Cancellation by Us

• We reserve the right to cancel a tour due to insufficient bookings, force majeure, or safety concerns.
• In such cases, we will offer a full refund or alternative options.

4.3 Refunds

• Refunds will be processed within 14 business days of cancellation.
• Bank transfer fees and currency conversion charges are non-refundable.
• Refunds will be made in the original currency of payment.

5. Travel Insurance

Travel insurance is mandatory for all bookings. You are required to have comprehensive travel insurance covering:

• Medical expenses and emergency evacuation
• Travel cancellation and interruption
• Lost or stolen baggage and belongings
• Personal liability

We recommend purchasing insurance at the time of booking to protect your investment.

6. Health and Safety

• It is your responsibility to ensure you are physically and mentally fit for the safari.
• You must inform us of any medical conditions, allergies, or dietary requirements before travel.
• We recommend consulting your doctor regarding vaccinations and malaria prophylaxis before travel.
• We reserve the right to refuse service to anyone who poses a safety risk to themselves or others.

7. Liability

• ChuiTrails Adventures acts as a tour operator and is not liable for incidents beyond our control.
• We are not liable for injury, loss, damage, or delay caused by third-party providers (airlines, hotels, lodges, etc.).
• We are not liable for any loss or damage to personal belongings during the safari.
• Our liability is limited to the total cost of the tour package booked.

8. Wildlife Encounters

• Wildlife sightings are not guaranteed and depend on natural conditions.
• You must follow safety instructions provided by our guides at all times.
• Maintain a safe distance from all wildlife as instructed by your guide.

9. Force Majeure

We are not liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to:

• Natural disasters (earthquakes, floods, fires)
• Pandemics and disease outbreaks
• Government actions, travel bans, and border closures
• Political unrest, strikes, and war
• Weather conditions affecting travel

10. Visas and Passports

• It is your responsibility to ensure you have a valid passport (minimum 6 months validity from entry) and appropriate visas for Kenya and any other countries visited.
• We can provide guidance on visa applications but are not responsible for visa denials or entry restrictions.

11. Code of Conduct

By booking with us, you agree to:

• Respect local cultures, traditions, and customs
• Protect the environment and wildlife
• Follow our guides' instructions at all times
• Treat fellow travelers and staff with respect
• Not engage in any illegal activities

12. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

13. Dispute Resolution

• We aim to resolve any disputes amicably and promptly.
• If a dispute cannot be resolved, it shall be referred to the Kenya Tourism Federation (KTF) or the relevant tourism authority for mediation.
• As a last resort, legal action may be taken in the courts of Kenya.

14. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be effective immediately upon posting on this page. It is your responsibility to review these terms periodically.
